Terms & Conditions of Sale

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING YOUR ORDER. IT IS ADVISABLE TO PRINT AND RETAIN A COPY OF THESE TERMS AND CONDITIONS ALONG WITH YOUR ORDER FOR FUTURE REFERENCE.

Terms of the Contract
These Terms & Conditions of 
Sale apply to all goods supplied by Your Watch Design; they do not affect your statutory rights.

The contract is subject to your right of cancellation (see condition 5 below).

We reserve the right to terminate the contract of sale if the price in the contract is not received from you in full.

Your Watch Design may change these Terms & Conditions of 
Sale without notice to you in relation to future sales.


1. Ordering from us 
You are deemed to place an order with us by ordering via our online checkout process. We will send you an order acknowledgement by email, detailing the products you have ordered.

Our acceptance of an order takes place when we despatch the order. When we despatch the order, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

We may refuse to accept an order:

(a) Where goods are not available
(b) Where we cannot obtain authorisation for your payment
(c) If there has been a pricing or product description error
(d) If you do not meet any eligibility criteria set out in our terms and conditions


2. Description and Price of Goods
We have taken every care to describe and show all items accurately as possible, as according to the manufacturer's specification. Despite this a slight variation in items may occur. We provide you with product information on the website. If there is anything which you do not understand, or if you wish to obtain further information, please contact us on sales@yourwatchdesign.co.uk

Every effort is made to ensure the prices shown on the website are accurate at the time of placing an order. If an item has been under priced in error we will contact you and offer the following three options:

1. Placement of a new order at the correct price of the goods;
2. Cancellation of the whole order; or
3. Cancellation of your order for the mis-priced goods and reconfirmation of your order for the correctly priced goods.

If you do not choose one of the three available options within 14 days your order will be cancelled or the under priced item(s) will be removed from your order. Any payment received from you with respect to the cancelled item(s) will credited back to your original method payment.

If within 14 days of accepting your order we discover that all of the items are unavailable we will contact you and advise we may cancel your order and refund or re-credit you within 7 working days. The refund will be credited back to your original method of payment.

If within 7 days of accepting your order we discover some but not all of the items are unavailable we will contact you and offer you the option of amending your order to substitute the unavailable item(s) with applicable alternative goods. If you do not choose a substitute alternative within 14 days the unavailable item(s) will be removed from your order and we will despatch the available goods. Any payment received from you with respect to the cancelled item(s) will be credited back to your original method of payment.

The price of an item does not include the delivery charge.

3.  Payment
Payment can be made by credit card or debit card via PayPal and shall be due before despatch of goods. If your payment fails we will advise you by e-mail. If you do not contact us to complete payment within 14 days your order will be cancelled.

No goods will be despatched until payment has been made in full and the funds have cleared. Please be aware if you are paying by PayPal eCheque these may take up to two weeks to clear.

4. Delivery
Delivery will be made to the address specified when you complete your order.

Orders will be delivered within 3-5 working days. Please note a working day is any day other than weekends and Bank or other Public Holidays.

We make every effort to ensure goods are delivered within five working days of acceptance of your order. However, Your Watch Design will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this event we will inform you of any delays as soon as possible.

Upon receipt of your order you will be asked to sign for the goods received. If the packaging does not appear to be in good condition then please refuse delivery. If you are unable to check the contents of your delivery then please sign for the parcel(s) as “UNCHECKED”. Failure to do so may affect any warranty claims that you make thereafter.

Please ensure you provide a delivery address where someone will be available to receive the delivery between 8.30am and 5.30pm, Monday to Friday. If our carriers are unable to complete a delivery due to nobody being present a calling card will be left asking you to contact them directly to arrange a re-delivery. If you do not contact the carriers within 2 days of receiving this card the goods will be returned to our Despatch Depot and a re-delivery charge may be applicable to your order.

Your Watch Design retains ownership of all items until they have been delivered to you (either directly, or by leaving them in a safe place or with a neighbour). Once your goods have been delivered the risk of damage to or loss of the item passes to you.

5. Your Right of Cancellation

If you wish to cancel an order please contact our Customer Services Team on sales@yourwatchdesign.co.uk If your goods have been despatched before cancellation you will be liable for the costs of returning the unwanted items.

This returns policy does not affect your statutory rights.


Orders that have been personalised cannot be cancelled once they have entered the production process. If you still wish to cancel the order beyond this point 100% of the order will still be charged.

If you wish to cancel your order you can notify us by email to sales@yourwatchdesign.co.uk before the goods have been placed into production.

Where goods have already been dispatched to you a refund is not possible.

Please note: In order to provide a fast service some products are immediately sent for production. Please check your order on screen and the confirmation email carefully as we cannot refund products which have been mis-spelt.


6. Refund Policy
If you are eligible for a refund we will refund you back to the method of payment you used when you originally paid for your order.


7. Warranty
All products supplied by Your Watch Design have a 12 months manufacturers warranty period from the date the goods were delivered (unless otherwise stated and excluding consumables). This warranty does not affect your statutory rights as a consumer.

Please note the warranty does not cover you for any defects in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with its intended use. 


8. Faulty Item(s)
If you receive goods that are faulty or incomplete on arrival you must notify us within 48 hours of receipt of the item by using the Contact Us page on the website

The goods should be returned to us in line with our Returns Procedure (see condition 12 below).

We will check products returned as faulty. If the fault is verified we will replace the item within 5 working days at no additional cost to you and you will be reimbursed for any reasonable carriage costs incurred by the return. If for any reason we are unable to replace the item (for example, due to discontinuation of a product) you will be offered a choice of a substitute alternative product or a refund for the faulty item.

If the goods you have returned are found not to be faulty you will be notified in writing and the goods will be returned to you at your cost.

9. Item(s) Damaged on Arrival
In the unlikely event of you receiving a damaged product you should notify us by using the Contact Us page on the website within 48 hours of receipt of the goods.

The goods should be returned to us in line with our Returns Procedure (see condition 12 below). Once we have received the goods back at our Despatch Depot we will examine the goods for the damage. If the damage is verified we will replace the item within 5 working days at no additional cost to you and you will be reimbursed for any reasonable carriage charge incurred by the return..

If the goods you have returned are found not to be damaged you will be notified in writing and the goods will be returned to you at your cost.

10. Wrong Item(s) Delivered
If, by mistake we supply you with an incorrect item you must notify us within 7 days by using the Contact Us page on the website. The goods should be returned to us in line with our Returns Procedure. Once we have received the incorrect items at our Despatch Depot the correct items will be shipped within 5 working days and you will be reimbursed for any reasonable carriage charge incurred by the return.

11. Item(s) Not Required
If you wish to return an unwanted item you must notify us in writing by using the Contact Us page on the website within 7 days of receipt of the item. A refund will be credited back to your original method of payment within 30 days of you notifying Your Watch Design of the cancellation.

The item should be returned to us in line with our returns instructions within 28 days of you notifying us. You will be responsible for returning the goods at your own cost, and they should be returned in their original packaging and 'as new'.

This condition does not apply to consumable items or personalised items, unless previously agreed in writing with Your Watch Design.

12. Returns Procedure

Before returning any items you must acquire a Return Merchandise Authorisation (RMA) number. Via the Returns  page on the website This number should be quoted on all correspondence, and a covering note should be included with your returned item(s) quoting your name, your order reference, a contact telephone number and your RMA number.

Items returned without a valid RMA number will be returned to you at your cost.

When returning faulty items we may still ask you to return goods yourself. On receipt Your Watch Design will reimburse the costs incurred*. Your Watch Design  shall pay you a reasonable* postage amount for the return of the product. We normally ask that goods are sent back via First Class Royal Mail (Recorded Delivery) but it may be necessary for us to arrange to collect certain items via a courier.

* Please obtain a proof of postage costs so we can reimburse you the full amount.

*Please note that by reasonable we mean any delivery service equivalent to the cost of Royal Mail Recorded Delivery and up to a maximum value of £10. We regret that we will not be able to refund excessive postage costs (for example goods being sent by special delivery or by courier when this is not necessary).  If the postage costs are going to exceed £10 please contact us for further advice.

 

Exceptions

If the deadline for reporting parcels damaged during transit is not met we regret that we will not be able to issue a refund or replacement goods.

 

Refunds
We will not confirm that we have received your return.  After receipt of your goods we aim to issue refunds within 14 working days. The cost of your gift will be refunded to the credit/debit card used to make the purchase. Please note refunds take 5 working days to clear from the point of processing.

For Non-Faulty Goods

If you have had a change of heart you must return the item to Your Watch Design unused and in its original condition within 7 days for a refund. Each returned product must include all parts, accessories, instructions and packaging, etc. This includes items such as cable ties and plug covers. Please note that if security seals are broken or if blister packaging has been opened then the product is not in its original condition.

 

Before returning any items you must acquire a Return Merchandise Authorisation (RMA) number. Via the Returns  page on the website This number should be quoted on all correspondence, and a covering note should be included with your returned item(s) quoting your name, your order reference, a contact telephone number and your RMA number.

Items returned without a valid RMA number will be returned to you at your cost.

Exceptions

We regret that we cannot accept returns on the following non-faulty products:

The products(s) has/have been personalised, made to order or customised in any way.

The packaging or any of the individual product components, has been unsealed or damaged.

The product(s) is/are perishable.

The non-faulty product does not arrive at Your Watch Design in a resalable condition.  In this case we will not be able to offer you a refund. We will call you to arrange to send the product back to you and to take payment for the subsequent delivery costs.

The product(s) are toiletries.

 

For Faulty Goods

If the product you have ordered is faulty you have 30 days in which to return it.  Parcels or items damaged in transit must be reported to Your Watch Design

 


13. Limitation of Liability
Your Watch Design will not be liable to you for any loss or damage in circumstances where:

1.There is no breach of a legal duty owed to you by Your Watch Design or by its employees or agents;
2.Such loss or damage is not a reasonably foreseeable result of any such breach;
3.Any increase in loss or damage resulting from breach by you of any item of this contract.

Nothing in these conditions excludes or limits the liability of Your Watch Design for death or personal injury caused by our negligence or fraudulent misinterpretation.

 

14. Images
Product images are for illustrative purposes and may differ from the actual product.

All designs contained in this website and used on our products are copyrighted and protected by law, any unauthorised reproduction of our designs will result in prosecution and financial recourse will be sought

Any images uploaded to the website for personalised products will be deemed [unless otherwise noted] as free from copyright and therefore we will assume the right to copyright the image for our own use

 

15. Voucher Codes

Voucher codes cannot be used when purchasing sale items. This applies to both monetary and percentage off vouchers.

Voucher codes can only be used online at YourWatchDesign.co.uk

Voucher codes have a cash redemption value of 0.001p.

Voucher Codes cannot be used in conjunction with any other Your Watch Design promotional voucher or any other gift voucher be it a registration voucher, a monetary voucher or discount voucher.

Voucher codes cannot be used on any other promotions on the website.

 

16. Miscellaneous

We reserve the right to discontinue any product, or make design changes to product specifications, or use different suppliers or manufacturers to those stated in the catalogue, without prior notice, as part of our continuous process of product and service improvement, or to improve product availability. All images are used for illustration purposes only.


Nothing in these Conditions affects the statutory rights of a consumer under (including but not limited to) the Consumer Protection (Distance Selling) Regulations 2000 or the Sale of Goods Act 1979 as amended from time to time.


While every effort is made to ensure health and safety information is available, we may be limited to the extent of information we can supply with the Goods depending on what is available from our suppliers. If you require further information on any health and safety information regarding the Goods then please contact us.


Offensive Weapons Act 1996 – where the law requires a minimum age for the purchase of certain goods, the customer confirms that he or she is over the required age and that delivery of the Goods will be accepted by a person over the relevant age limit.

 

All goods which appear for sale on the Your Watch Design web site ("the web site") are advertised as invitations to treat, and no offer of sale shall be implied.

By placing an order with Your Watch Design you are offering to purchase the goods detailed within that order, which Your Watch Design may or may not accept at their sole discretion.

If an order is accepted, Your Watch Design will send you an e-mail to confirm.

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information, supplied by you during or after the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

 

A number of products represented on Your Watch Design are made to order. In this instance, full payment for the goods will be taken in advance as the products are bespoke in nature. Please note that made to order and personalised products cannot be returned except in the event of a fault.
